This Privacy Policy explains how Fairwinds, LLC ("Fairwinds," "we," "us," or "our") collects, uses, and protects information when you visit our website, contact us, request or book a charter, or otherwise interact with our services. It also covers our separate SMS text-messaging service for vessel maintenance, described in Part B below. By using our website or services, you agree to the practices described here.
Part A — Website & Charter Services
This part applies to visitors to fairwindsnewport.com and to guests and clients who inquire about or book charters, lessons, or consulting with us.
1. Information We Collect
We collect only what we need to respond to you and provide our services:
- Information you give us — your name, email address, phone number, preferred dates, party size, vessel of interest, and any details you include when you submit our charter inquiry form, email us, or call.
- Booking & payment information — details needed to arrange a charter. Payments are handled by our third-party payment processors; we do not store full card numbers on our website.
- Automatically collected data — standard technical information such as your IP address, browser type, device, pages viewed, and timestamps, collected through your browser and analytics tools.
- Cookies & similar technologies — used to operate the site, remember preferences, and understand site usage. See Section 3.
2. How We Use Information
- Respond to inquiries and provide quotes, availability, and charter details;
- Arrange, confirm, and manage charters, lessons, and consulting engagements;
- Process payments and maintain business and tax records;
- Send service-related communications about your booking;
- Maintain, secure, analyze, and improve our website and services; and
- Comply with legal obligations and enforce our Terms & Conditions.
3. Cookies & Analytics
Our website uses cookies and similar technologies to function properly and to help us understand how visitors use the site. You can control or disable cookies through your browser settings, though some features may not work as intended if you do. We may use analytics providers that set their own cookies to report aggregate, non-identifying usage statistics.
4. How We Share Information
We do not sell your personal information. We share it only:
- With service providers who help us operate our business — for example, our website host, form-submission provider, analytics tools, and payment processors — under obligations to protect it and use it only to provide services to us;
- With captains, crew, or vendors strictly as needed to deliver a charter or service you have requested;
- When required by law, legal process, or to protect the rights, safety, or property of our guests, our company, or others; and
- In connection with a business transfer, such as a merger or sale of assets, subject to this Policy.
5. Data Retention & Security
We retain information for as long as needed to provide our services and to meet legal, accounting, and operational requirements, then delete or anonymize it. We use reasonable administrative and technical safeguards to protect information, though no method of transmission or storage is completely secure.
6. Your Privacy Rights
Depending on where you live, you may have the right to request access to, correction of, or deletion of your personal information, and to opt out of certain uses. To make a request, contact us using the details in Section 9. We will not discriminate against you for exercising these rights.
7. Third-Party Links & Social Media
Our website may link to third-party sites and platforms (such as Instagram). We are not responsible for the privacy practices of those sites; please review their policies separately.
8. Children's Privacy
Our website and services are intended for adults. We do not knowingly collect personal information from children under 13. If you believe a child has provided us information, please contact us and we will delete it.
